Entwurf zum GesRÄG 2013

Der Begutachtungsentwurf zum Gesellschaftsrechts-Änderungsgesetz 2013 (GesRÄG 2013) wurde am 22.3.2013 vom Justizministerium vorgelegt und soll mit 1.7.2013 in Kraft treten. Kernpunkt des GesRÄG 2013 ist die Reduktion des Mindeststammkapitals auf 10.000€ sowie der Gründungskosten für eine GmbH-Gründung. Damit soll eine deutliche Steigerung der Anzahl der GmbH-Neugründungen erreicht werden.

Contractul de vanzare in Lumina noului Cod Civil

Noul Cod Civil român, adoptat în baza Legii nr. 287/20091, ulterior modificat şi completat în baza Legii nr. 71/20112 pentru punerea în aplicare a Legii 287/2009 privind Codul Civil, înglobează o reglementare amplă a contractului de vânzare, axată pe actualizarea dispoziţiilor din Codul Civil de la 1864, precum şi pe includerea în noua reglementare a anumitor soluţii din practică şi doctrină.

Noutăți privind materia contractului de locațiune în viziunea noului Cod Civil

Începând cu 1 octombrie 2011 a intrat în vigoare noul Cod Civil1 ce are ca principale deziderate ca prin reglementările sale să răspundă nevoilor concrete ale societății românești actuale și să asigure un instrument modern de reglementare a relațiilor sociale actuale în plină dezvoltare. Materia contractelor, printre care şi contractul de locaţiune, a făcut obiectul preocupării legiuitorului noului Cod Civil, care în ceea ce privește contractul de locațiune a amendat semnificativ materia privind acest tip de contract. În ciuda efortului legiuitorului de a îmbunătăţi reglementarea anterioară în această materie, unele din reglementările noi sunt totuși criticabile.
