New block exemption regulation for vertical agreements: No “safer harbour” for large distribution undertakings? From 1 June 2010 a new block exemption is in force for vertical agreements. The European Commission intends a continuation of the proven basic principles. The area of application of the new block exemption is more limited and there will be more single case investigations. Starting with 1 June 2010, the safe harbour is closed for new agreements with purchasers whose market share is over 30%.
