The article concerns recent developments in Austrian unfair competition law: In the CJEU ruling of 9. 11. 2010, C-540/08, Mediaprint/„Österreich“, the Austrian prohibition in principle of the offer of bonuses to consumers (B2C) had been declared as contradicting EU law. In this article, open questions with regard to the still existing similar provision on the prohibition of the offer and grant of bonuses (also) in a B2B relationship are discussed.
