Austrian legislators have been reluctant – if not outright hostile – to permit any kind of online sale of medicinal products within the country. It has been just over two years since Austrian pharmacies were finally granted the right to sell medicinal products to consumers.
The online sale of medicinal products within Austria is still, however, quite restricted. Before 2015 pharmacies seated in any EEA country could sell certain medicinal products to Austrian customers, while Austrian pharmacies were not allowed to do so. A further liberalisation – especially an abrogation of the restriction that only public pharmacies may sell medicinal products to consumers – is not expected anytime soon, although two requests were recently made by a well-known drug store retailer. Both requests were immediately dismissed by the Austrian Constitutional Court due to procedural issues.
